These terms explain when The Swink Group may text you, what kinds of messages you may receive, what they may cost, and how to tell us to stop. If you don't want the texts anymore, there should be no mystery about what to do.

SMS Terms & Conditions · Effective August 30, 2026

These SMS Terms & Conditions describe how Jeremy Allen Swink, LLC, doing business as The Swink Group (“The Swink Group,” “TSG,” “Company,” “we,” “us,” or “our”) communicates by text message and the choices available to people who participate in our messaging program.

Sender

Article 01: Who Sends the Messages#

SMS communications covered by these Terms are sent by or on behalf of Jeremy Allen Swink, LLC, doing business as The Swink Group.

We may use third-party communications platforms, telecommunications providers, or messaging service providers to transmit and manage messages.

Messages may originate from one or more business telephone numbers associated with The Swink Group. Telephone numbers and technology providers may change over time.

Message Types

Article 02: What We May Text About#

Depending on what you have requested, consented to, or your relationship with The Swink Group, SMS messages may include:

  • appointment confirmations and reminders;
  • Strategy Call or consultation communications;
  • responses and follow-ups related to inquiries;
  • client onboarding communications;
  • project, consulting, or advisory updates;
  • customer service or support communications;
  • Remote Assistant or candidate-placement communications;
  • billing or account-related notices;
  • requested operational communications; and
  • marketing or promotional messages where you have separately consented to receive them.

Receiving one type of message does not necessarily mean you have consented to every other type of SMS communication.

Opt-In

Article 03: How You May Consent#

You may opt in to SMS communications through an affirmative consent method made available by us.

Depending on the interaction, consent may be provided by:

  • selecting an SMS consent option on a website form;
  • providing SMS consent through a booking or scheduling flow;
  • making an affirmative written or electronic request;
  • initiating a text-to-join process after being presented with the applicable disclosure; or
  • another affirmative consent method that reasonably shows your agreement to receive the described messages.

Merely providing a telephone number does not by itself constitute consent to receive every category of automated or marketing text message.

Consent

Article 04: SMS Consent Is Optional#

Where you are presented with a choice to consent to SMS messaging, the consent choice is intended to be voluntary.

You should not be required to consent to marketing text messages merely to submit a general inquiry, browse our website, or purchase Services where SMS marketing consent is not necessary for the transaction.

Where different categories of messaging require separate consent, we may provide separate choices for marketing and non-marketing communications.

Frequency

Article 05: Message Frequency#

Message frequency varies.

The number of messages you receive depends on the type of communication you requested and your relationship with The Swink Group.

For example, somebody with an upcoming appointment may receive appointment-related messages, while an active client may receive additional operational or engagement communications.

Marketing messages, where separately consented to, may be sent from time to time.

Carrier Charges

Article 06: Message and Data Rates#

Message and data rates may apply.

Charges depend on your wireless carrier, service plan, location, and other factors controlled by your provider.

The Swink Group does not control or receive wireless carrier charges associated with your mobile plan.

If you have questions about your text or data plan, contact your wireless provider.

Opt-Out

You can tell us to stop.

You may withdraw SMS consent by replying STOP to a message from The Swink Group. Clear requests such as QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE may also communicate that you no longer wish to receive applicable messages. Other reasonable methods that clearly communicate an opt-out request may also be honored as required by applicable law.

Opt-Out Processing

Article 07: What Happens After You Opt Out#

After a valid SMS opt-out request, you may receive a one-time confirmation acknowledging that the request has been processed.

After that confirmation, applicable SMS communications covered by the opt-out will cease in accordance with applicable law and messaging-provider requirements.

If you later want to receive SMS messages again, you may opt in again through an available consent method.

Opting out of SMS does not automatically opt you out of email, telephone, contractual, or other communication channels.

Delivery

Article 09: Carrier and Network Delivery#

SMS delivery depends on telecommunications networks, carriers, messaging providers, device availability, network conditions, and other systems outside our direct control.

Messages may occasionally be delayed, filtered, blocked, or undelivered.

Carriers are not liable for delayed or undelivered messages.

The Swink Group does not guarantee uninterrupted or error-free delivery of every text message.

Records

Article 10: Consent and Messaging Records#

We may maintain records reasonably related to our messaging program, including:

  • telephone number;
  • consent status;
  • date or source of opt-in where available;
  • message history;
  • delivery or communication records;
  • HELP requests;
  • opt-out requests; and
  • other records reasonably necessary for operations or compliance.

These records may be processed through third-party communications platforms used to operate our messaging systems.

Mobile Data Privacy

Your SMS consent isn't inventory.

Your mobile number, SMS consent information, and messaging history are treated as personal information under our Privacy Policy.

We do not sell, rent, or provide mobile information or SMS consent information to third parties or affiliates for their own marketing or promotional purposes.

Service providers, subcontractors, communications platforms, and other vendors may process information where reasonably necessary to support communications, customer service, technology, or other legitimate services performed for us. SMS opt-in information and consent are not provided to third parties for their independent marketing use.

Third Parties

Article 11: Messaging Service Providers#

The Swink Group may use third-party platforms and telecommunications providers to manage, transmit, route, record, or administer SMS communications.

These providers may process mobile information as necessary to provide their services to us.

Their independent infrastructure, availability, carrier relationships, and security practices are outside our direct control.

Compliance

Article 12: Applicable Messaging Requirements#

Our messaging practices are intended to operate in accordance with applicable federal and state law and applicable carrier, telecommunications, and messaging-provider requirements.

This may include requirements concerning:

  • consent;
  • sender identification;
  • marketing communications;
  • message disclosures;
  • opt-out rights;
  • recordkeeping; and
  • application-to-person messaging registration.

Nothing in these Terms limits consumer rights that cannot legally be waived.

Updates

Article 13: Changes to These SMS Terms#

We may update these SMS Terms & Conditions as our Services, messaging practices, technology, providers, or applicable requirements change.

When we update these Terms, we will revise the Last Updated date displayed on this page.

Material changes may be communicated through other reasonable methods where required by applicable law.

Legal Relationship

Article 14: Relationship to Other TSG Terms#

These SMS Terms & Conditions should be read together with The Swink Group's Terms of Service and Privacy Policy.

A client engagement may also be governed by a Service Agreement, Statement of Work, placement agreement, proposal, order form, or other written agreement.

Where applicable, those agreements continue to govern the underlying professional relationship even if you choose to stop receiving SMS messages.

Governing Framework

Article 15: Governing Law#

Jeremy Allen Swink, LLC is organized in the State of Wyoming, United States.

These SMS Terms are governed by applicable federal law and the laws of the State of Wyoming, except where applicable law requires otherwise.

Disputes arising from these Terms are subject to the applicable dispute-resolution provisions contained in our Terms of Service or another controlling written agreement.
